Having worked with thousands of doctors throughout the United States, the thing that impressed me most is the love and commitment they have for their profession and their patients. It is an honor to serve those who serve others so well. However, in today’s litigious environment a doctor can do everything right, provide a perfect standard of care, and still lose a lawsuit. Sarah Lawhorn, president of a malpractice insurer, stated, "Some jurors freely admit that they’ll overlook whether the doctor violated the standard of care if they feel sorry for the plaintiff." Many judgments are not a product of justice and enforcement of the law, but a result of sympathy for the plaintiff. The current litigious environment is affecting how physicians interact and treat patients and has resulted in many leaving the profession.

It is a tragedy to see a legal system prevent doctors from helping others and doing what they love to do. I recently received a letter from one of my personal physicians, Mark Hopkins. In the letter he wrote, "After enjoying twenty years of orthopedic surgery, I leave behind old friends plagued by continued problems with health insurance companies and rising malpractice premiums that have made it less desirable to continue in the private practice of medicine. The true medical part of caring for patients and getting to know patients has been truly rewarding. I will remember that always."

While my wife was pregnant with our last child, she received a letter from her physician telling us that due to the litigation environment he was closing his practice because "the rising cost of malpractice insurance has made it impossible for me to continue to practice medicine." I will never forget holding and comforting my crying wife after she received this letter when she realized Dr. Sellers was not going to be delivering our baby. I assured her we would be able to find another physician. My wife answered through her crying, "But I wanted Dr. Sellers to deliver our baby."

It is a tragedy to see physicians’ practices affected or closed as a result of lawsuits, especially when these tragedies could have been avoided with the proper knowledge, training, and guidance. The American Society for Asset Protection provides physicians with the education and resources they need to protect assets and prevent lawsuits. It is our goal and mission to ensure that no physician will have a lawsuit affect their care for their patients.

The training our experts have delivered has helped thousands of physicians. We are passionate about getting this message out to as many physicians as possible. It is our goal and mission as a company to ensure that the quality of care physicians give their patients will never be affected directly or indirectly by a lawsuit.
